What is a Drink Banning Order?
Drink Banning Orders are civil orders that can be made against an individual aged at least 16 if they have engaged in criminal or disorderly conduct while under the influence of alcohol. A Drink Banning Order may impose any prohibition on the individual that the court considers necessary to protect others from further crime or disorderly conduct by that individual while under the influence of alcohol. This can include banning them from entering the pubs and clubs in their local area if such a prohibition is considered necessary by the court. Drink Banning Orders can last for between two months and two years.
Drink Banning Orders are to be used to address and individual's alcohol misuse behaviour and protect others and their property from such behaviour. Alcohol misuse, and particularly that associated with anti-social and disorderly behaviour, is a significant concern for many within our communities. Such alcohol misuse behaviour is a strong contributory factor associated with a wide range of crimes or disorderly behaviour can include:

public order offences (often anti-social by nature, these offences can involve rowdy, threatening and abusive behaviour, disorderly groups of people, and urinating in public);

criminal damage;

minor and serious assaults;

violent offences; and
-
traffic offences.
Drink Banning Orders can be applied for by either the police (including British Transport Police) or local authorities in England and Wales against individuals aged 16 and over who are responsible for alcohol-related crime or disorder.
